Tofino Yoga operates in British Columbia, Canada, and handles personal information in accordance with British Columbia’s Personal Information Protection Act (PIPA) and other applicable privacy laws.
Information We Collect
Depending on how you interact with Tofino Yoga, we may collect:

* information provided through participant waivers;
* health, medical, injury or other sensitive information that you voluntarily provide where relevant to your participation;

We aim to collect only information that is reasonably necessary for the operation of our business, delivery of our services and the safety and administration of our programs.
Sensitive and Health Information
Certain Tofino Yoga programs and activities may require participants to provide limited health or other sensitive personal information.
This may include information about injuries, physical limitations, medical conditions, pregnancy, allergies or other circumstances that may reasonably affect a participant’s ability to participate safely or may help us appropriately accommodate their participation.
We recognize that health information is particularly sensitive. We will only collect, access, use and disclose this information where reasonably necessary for the purposes for which it was provided, or where otherwise permitted or required by law.
Participants should only provide health information that is relevant to their safe participation or that they believe Tofino Yoga should reasonably know.
Providing health information to Tofino Yoga does not create a medical or health-care provider relationship. Participants remain responsible for determining whether a class, training, retreat or activity is appropriate for them and should seek advice from an appropriate health-care professional when necessary.
Waivers and Smartwaiver
Participants may be required to complete an electronic waiver before participating in certain Tofino Yoga classes, trainings, retreats, workshops or other activities.
Tofino Yoga currently uses Smartwaiver, a third-party electronic waiver platform, to collect and manage participant waivers.
Information submitted through a waiver may include your name, contact information, date of birth, emergency contact information, electronic signature and information relevant to your health, physical condition or safe participation in an activity.
Information submitted through Smartwaiver is processed using Smartwaiver’s systems and may therefore also be subject to Smartwaiver’s applicable privacy, security and data-processing practices.
Tofino Yoga seeks to limit the information requested through its waivers to information reasonably necessary for participant registration, safety, accommodation, administration, insurance, legal purposes and delivery of our services.
Why We Collect Your Information
We may use personal information to:
* process bookings and registrations;
* communicate with you about your booking, class, training, retreat or other service;
* administer participant waivers;
* understand information relevant to safe participation and reasonable accommodation;
* respond appropriately in the event of an emergency or incident;
* provide and manage our programs and services;

* maintain appropriate participant and business records;
* process payments and maintain transaction records;
* comply with legal, insurance, accounting and regulatory requirements; and
* send newsletters or promotional communications when appropriate consent has been provided.
We will not use sensitive health information for marketing purposes.
We will not use personal information for purposes unrelated to those for which it was collected unless we obtain appropriate consent or are otherwise permitted or required by law.
Email and Marketing Communications
Providing your email address when making a booking or completing a waiver does not automatically enrol you in Tofino Yoga’s marketing communications.
Where required, we obtain appropriate consent before adding individuals to promotional or newsletter communications.
You may unsubscribe from marketing communications at any time using the unsubscribe option provided in those communications.
We may still contact you regarding an existing booking, registration, payment, waiver, training, retreat or other service where that communication is reasonably necessary to provide or administer the service.
How We Share Information
Tofino Yoga does not sell or rent personal information.
We may share personal information with third-party service providers where reasonably necessary to operate our business and provide our services. These providers may include booking, waiver, payment-processing, website, email, accounting, insurance and technology service providers.
We seek to provide third parties only with the information reasonably necessary for the services they perform.
Personal information may also be disclosed where required or permitted by law, including where reasonably necessary to respond to an emergency, protect an individual’s safety, comply with legal proceedings or satisfy legal, regulatory or insurance obligations.
Service Providers and Storage Outside Canada
Some of the third-party platforms used by Tofino Yoga may store or process information outside British Columbia or outside Canada.
As a result, personal information processed by these providers may be subject to the laws of the jurisdiction in which it is stored or processed and may be accessible to courts, law-enforcement agencies or governmental authorities in accordance with those laws.
Consent
By providing personal information to Tofino Yoga, you consent to its collection, use and disclosure for the purposes identified at or before the time of collection, or as otherwise permitted by applicable law.
